A unit trust must keep records of all its units, transfers and any other changes. This precedent is designed to keep track of any changes in relation to the unit trust deed.

Clause 5.1 of the precedent “Unit trust deed” imposes an obligation on the trustee to maintain records regarding the issue of units and a register of the unit holders. The register of the unit holders and unit certificates signed by the trustee are often called into evidence where a dispute arises between unit holders.
