This precedent is a notice of attornment for the existing tenant of a property that is under a contract for sale.
The precedent is used where there is a sale subject to an existing tenancy (whether a continuing or fixed residential tenancy agreement, or other registered or unregistered lease).
The notice serves to direct the tenant under the tenancy or lease to pay all rent and other monies payable by it under the tenancy or lease to the purchaser or as directed by the purchaser. This notice is usually prepared by the vendor’s representative and handed to the purchaser’s representative on completion.
