This precedent is a letter which is used to send the contract for signing, the deposit and cooling off certificate to the vendor’s solicitor, conveyancer or other representative. Use this letter when acting for a purchaser in a conveyancing matter to initiate exchange of contracts. This letter is drafted on the basis that: · all amendments to the contract have been previously negotiated; and · the deposit cheque is enclosed. If the further amendments are to be included (such as additional special conditions) they should be enclosed with this letter. Further, if the agent holds the deposit or if a deposit bond is to be enclosed instead of a cheque this letter should be amended accordingly. |
For a precedent letter to the purchaser client attaching the contract for execution, see the separate precedents “Letter to purchaser client advising exchange, settlement date and stamp duty amount” and “Letter to purchaser client advising auction, settlement date and stamp duty amount”.
