This precedent is for use where the sale is to take place by auction and the vendor’s solicitor sends the agent a letter enclosing the contract in duplicate on or before auction day. Once the property is sold under the hammer at auction, or subsequently on auction day if the property is passed in, counterpart contracts are available for signing by the vendor and purchaser respectively and exchange can be effected.
