This precedent is for use with the 2005 or 2014 edition of the Contract for Sale of Land by the Law Society of NSW and Real Estate of NSW. This special condition is used where there are interdependent contracts and there are 3 options which can be used depending on the situation.
The first option provides that the contracts must be completed together and if one contract cannot or is not completed, the other contract cannot be either. The second option makes interdependency an option for the vendor. The vendor can either insist on or waive the requirement that both contracts be completed. The third option makes completion of the contract by the purchaser conditional on the settlement of their own contract of sale.
