This precedent is a letter used when acting for a vendor client in a conveyancing matter to send a request for a discharge of mortgage or discharge authority to the lender.

A discharge authority is necessary to request that the vendor’s lender release the mortgage held over the title of the property. The property cannot be transferred to the purchaser without a discharge of mortgage to be handed over by the vendor’s lender at settlement.

All lenders have different discharge authority forms specific to their institutions. You should obtain the correct form from the lender and enclose it under cover of this letter.
